Fines and surcharges in Uruguay: what happens if you pay late (and how to fix it)

Paying a tax late triggers mora: a fine plus monthly surcharges, automatically. But it can be regularized. Explained with official sources.

If you pay a tax after its due date, the DGI doesn't need to “fine” you by hand: mora kicks in by itself, with a fine and surcharges. The good news: it can almost always be regularized. Here it is in plain words.

Mora is automatic

It isn't a discretionary penalty: simply by not paying on time you are already in mora. The Tax Code puts it like this:

«La mora se configura por la no extinción de la deuda por tributos en el momento y lugar que corresponda, operándose por el solo vencimiento del término establecido. Será sancionada con una multa sobre el importe del tributo no pagado en término y con un recargo mensual»

In English: Mora arises from not settling a tax debt at the right time and place, taking effect by the mere expiry of the deadline. It is penalized with a fine on the unpaid tax plus a monthly surcharge.

What's added: fine + surcharges

Two things apply to the unpaid tax: a fine (a percentage of the tax, larger the later you pay) and monthly surcharges (interest the DGI sets month by month and capitalizes). That's why the debt grows over time. You can see the current rate and compute the surcharge at the DGI:

How to regularize: payment facilities

If you already owe, don't let it grow: the DGI offers payment facilities (convenios) to pay in monthly instalments. The sooner you face it, the fewer surcharges accrue. Check the current conditions and number of instalments with the DGI.

How to avoid it
